TERMS AND CONDITIONS
These Terms and Conditions must be read and signed as understood before starting a class with The Drop. If you attend the class without signing this form, it is assumed that you agree to the Terms and Conditions stated and that you are safe to exercise.
THE DROP OVERVIEW
1.1 Classes
The Drop holds fitness and wellbeing classes within the studio for participants who are over the age of 18 years old, the only exception to this is the Mums Club where participants can bring their baby between the ages of 8 weeks to 12 months old. There is an additional policy for the Mums Club in which all participants for this class are required to sign.
1.2 Events/ Workshops
We may, at times, hold events such as, Hyrox simulations or exercise workshops of which the terms and conditions will remain the same as stated, unless we need to update these terms to align with the activity. We will notify you of these changes prior to the event.
1.3 Training Programmes or Recommendations
The Drop may provide training programmes or exercise recommendations for participants to complete at their own discretion and within their own time.
2. LIMITATION OF LIABIILITY
Neither The Drop nor its instructors are liable for harm, personal injury or death arising from participation in any activities during the class or event/workshop unless caused by the negligence of The Drop and/or its instructors.
3. SCOPE OF RESPONSIBILITY
The Drop has instructors who are qualified Personal Trainers. Personal Trainers are here to help participants improve their physical health and mental wellbeing through exercise. Please note Personal Trainers are not medical professionals and are unable to advise the participant as to the suitability of any class or event/workshop. If anything arises that sits outside of this scope of practice the participant will be advised to seek the help of a medical professional.
4. BOOKINGS
4.1 All bookings for classes are to be made through the WodBoard Booking system.
4.2 Class Capacity
We require all bookings to be made through Wodboard to help monitor class capacity. Our classes only have a small number of participants. A member who doesn’t book their class and shows up on the day is at risk of not being able to attend the class if it is fully booked.
4.3 Cancellations
We have a 12hr cancellation rule on all classes. Failure to cancel the class with a 12hr notice will result in your session being charged.
4.4 Expired Classes
The class subscription must be completed within the stated timeframe. Sessions will not be rolled over into the following month if unused.
5. PAYMENTS
5.1 Class Memberships
A rolling monthly class membership can be selected from the Wodboard app. The payments will be made from the 1st of each month. This can be prorated if the class membership is purchased within the month.
5.2 Day Pass
If a member wishes to join the classes on ad hoc basis they can purchase a day pass. This pass must be used within one month of purchase.
5.3 Minimum Term & Cancellations
There is a minimum term of one month on a class membership. The Drop requires a 1-month cancellation notice. The cancellation notice is to be made by email to: contact@thedropfitness.co.uk
5.4 Rate Increases
Our rates are reviewed regularly, and we may increase them from time to time. We will notify you of any such increases. Any increases will take effect from notification to you (being no earlier than the date of that notification).
5.5 Refunds
We do not offer refunds on sessions, other than in exceptional circumstances at the discretion of The Drop.
5.6 Freeze Option
Subscriptions can be frozen if a member is going on holiday or is unwell/injured and has medical evidence of this in writing. A minimum of a one-month notice is required and the member will need to inform The Drop via email to: contact@thedropitness.co.uk
6. DATA USE AND PROTECTION
6.1 By accepting these Terms and Conditions, you acknowledge that we will hold and process data about you to the extent necessary to provide our services to you.
6.2 We will take appropriate measures to prevent the unauthorised use or processing, or the loss or destruction of, any personal data you provide to us. Information you provide or we hold about you may be used by us subject to and in accordance with the Data Protection Act 2018 to assist in the provision of our services to you.
6.3 We will, unless you specifically ask us to refrain from doing so, use your contact details to keep you informed about other services and products provided by us. If you do not want to receive those kinds of communications from us then you may opt-out of receiving them.
6.4 Where we hold your Personal Data you have number of rights in respect of it. You may at any time write to us requesting a copy of your Personal Data (as defined by the Data Protection Act 2018). If any such data is incorrect you may request rectification of it.
6.5 If you are unhappy with the way that we have processed your Personal Data, you are entitled to make a complaint to the UK’s data regulator, the Information Commissioner’s Office.
7. HEALTH AND SAFETY
Please note that when you exercise there is an increased risk to your health and safety. To reduce the risk please follow the instructions below:
7.1 Accidents and Emergencies
In the event of an accident or emergency, The Drop’s instructors will perform First Aid on class participants. The incident will be logged, and serious incidents will be reported to HSE. Participants are consenting to receiving First Aid in an accident or emergency and consenting to their details of the incident being stored and/or reported.
7.2 Lighting
Our classes are lit by dim lighting. If this makes it difficult for you to see, which could pose a risk to your health and safety, please let the instructor know and they will be able to brighten the lights in the studio.
7.3 Training alongside others
When exercising please take care of yourself and other people within the class. Ensure that you and other members have adequate space to perform the exercises.
7.4 Exercise Guidance
Please take note of the technical guidance given by the instructor.
7.5 Damage to Property
If you damage or notice damage of the property of The Drop, please inform the instructor immediately.
7.6 Personal Safety
When training, train at an intensity you are comfortable with and avoid overexerting yourself.
Stay hydrated throughout the class.
If you experience pain whilst performing the exercise, please stop and let the instructor know.
If you start to feel unwell, alert the instructor immediately.
Be aware of equipment and weights being on the floor as you move throughout the studio.
Be aware of the pillars in the studio. We have protected these with column padding for your own health and safety.
If you are running late, you will still need to ensure you complete a thorough warmup before commencing the session and is your responsibility to do so.
7.7 Infectious Disease/illness
Please do not attend the class whilst suffering from any infectious or contagious illness, disease, or other ailment or whilst suffering from a physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other participants.
BY SIGNING THIS FORM, YOU ARE CONFIRMING THAT:
You have read, understood, and agree with the Terms and Conditions.
The Drop is not liable for any harm, personal injury or death when participating in the training programmes or exercise recommendations, unless caused by the negligence of The Drop and/or its instructors.
That you will adhere to the Health and Safety Instructions given above.
That you consent for The Drop’s instructors to provide first aid in an accident or emergency, and record and report the incident.
