1. CROSSFIT STRENGTH BASE GYM
1.1 CROSSFIT Strength Base (referred to as 'we / our') is managed by James Fry Properties, Chequers Cottage, Hook, RG29 1TL
2. ACCEPTANCE OF MEMBERSHIP
2.1 We reserve the right to verify, or require proof of all information given in order to maintain a membership.
Any illegal or wrongful practice used in order to obtain such membership could result in the cancellation of all membership rights and lead to the payment of all monies due to the Strength Base, as well as using the correct reporting process to law enforcement services.
Upon successful completion of the membership process, PINs / Passcodes will be emailed to the member, the PIN/Passcode entitles the holder to all the rights and privileges exercisable by the category of membership of the holder, the member will also be issued a personal key fob for contactless entry at a date agreed with the gym manager.
2.2 The completion of an application for membership shall constitute a legally binding agreement between the member and the Gym. We reserve the right to transfer the agreement to another organisation or bring the membership agreement to an end.
2.3 The member agrees to be bound by and adhere to the Gym code of conduct, and accepts the associated penalty scheme for breach of conduct.
2.4 PIN numbers / Passcodes are issued to all current members and must be used at the vehicle access gate, turnstile, and other PIN protected doors to gain membership rights every time a visit is made to the Gym. PIN numbers / passcodes may only be used by the registered member and any fraudulent use of or sharing of the PIN number / Passcode by the member will result in cancellation of the membership with no refund, as will abuse of use of the personal keyfob.
2.5 You must be aged 16 or over to join CrossFit Strength Base and use the facility
2.6 We are currently operating with one CrossFit trainer for our classes. If the trainer is unable to attend a class due to unforeseen circumstances, the class with be cancelled, but the programming will still be available. If the coach's absence is going to extend longer than 1 day, we will do our best to provide cover.
3. LIMITATION OF LIABILITY
3.1 The member is responsible for the consequences of any use of any of the facilities of the Gym. we will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise; this is applicable to the Gym, car park and any other area within the building land on which the gym is located.
3.2 The members is responsible for creating a safe environment for themselves and others at all times whilst at the Gym.
4. PHYSICAL HEALTH OF MEMBER
4.1 The member confirms that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member confirms that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
4.2 The member must inform us if there are any changes to the PAR-Q created at the point of joining. The member understands that they are responsible for their own well-being and safety whilst with the Gym, and in any emergency they will call the emergency services on 999, or use the panic buttons located around the Gym.
5. MEMBERSHIP
5.1 There is only one category of membership, and we reserve the right to edit, remove, and add to these at any time.
5.2 We reserve the right to, from time to time, run promotional campaigns and rates.
PERSONAL TRAINING
Members are not permitted to carry out personal training activities on the premises. Only persons approved in writing by Crossfit Strength Base are permitted to engage in Personal Training services within the facility. Any member found to be providing personal training services, whether paid or unpaid, will, at the discretion of Strength Base Management, receive a Code of Conduct 'strike' or 'strikes' or have their membership terminated.
6. MEMBERSHIP CHARGES, PAYMENT OPTIONS & TERMINATION OF MEMBERSHIP
6.1 All members are liable to pay all membership fees irrespective of actual usage of the Gym.
6.2 Members must pay their membership fees in monthly instalments via Direct Debit through the WodBoard app.
6.3 We reserve the right to adjust Membership fees.
6.4 The member can cancel their direct debit directly with the bank and this will automatically cancel their membership.
6.5 We do not process or accept termination requests sent by post or email, or in person.
For the avoidance of any doubt, in the unlikely event of exceptional circumstances where a such a membership has been brought to an end prior to the end date and a refund is deemed appropriate by the Club, any refund would be calculated as a prorated amount based on time left vs time used.
7. MEMBERSHIP SUBSCRIPTIONS
Right to refuse orders
We reserve the right not to fulfil and to cancel membership orders:
1. In the event of obvious inaccuracies in prices, except that we may fulfil your order at the correct price, with your consent.
2. If we are unable to obtain payment authorisation from the issuer of your payment card.
3. If at the discretion of the gym management, the application submitted is from a person who is deemed to not be an appropriate user (example, someone who may have had their membership previously removed).
Delivery
We will deliver the membership details to the email address you supply to us when you join. You agree that we will not be responsible for failure to deliver the membership information if you have supplied us with an incorrect email address. We will not be liable for your email providers spam filters should your email be diverted to a spam mailbox.
Delay in delivery and non-delivery
We will not be liable to you for any delay in delivery or non-delivery of membership information in the following circumstances:
1. where the issuer of your payment card refuses to authorise payment to us;
2. where such delay or failure is due to circumstances beyond our control or the control of our sub–contractors and agents, including but not restricted to war, electricity power failure, utilities failure, failure of telecommunications links, failure of transport infrastructure, fire, flood, government act, act of God, legislative constraints, strikes, labour disputes or malicious damage involving employees;
3. where the email address supplied to us by you is incorrect.
Card Payment
If you are under 18 or are not using your own credit/debit card to pay for the subscription, you must ask the permission of the credit/debit card holder before entering the payment details. By clicking "Submit" you are confirming that you have obtained the express prior permission of the credit/debit card holder.
8. EXPULSION OF MEMBERS OR TERMINATION OF MEMBERSHIP BY THE GYM
8.1 The Centre may expel members or may terminate the membership of any member:
8.1.1 without notice and with immediate effect if the member's conduct, whether or not such conduct is the subject of a complaint by another member or group of members, and is such that in the reasonable opinion of the Gym, it may be injurious to the character, name or interests of the Gym or is such that it renders the member unfit to associate with other members of the Gym or is such that it is not appropriate for the member to continue their membership or the member's behaviour is in the reasonable opinion of the Gym to be inappropriate and / or unacceptable.
8.2 By notice in writing if any part of the membership fee which is due and payable remains unpaid.
8.3 A member whose membership is terminated by the Gym, shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their annual or monthly membership fee.
9. GYM FACILITIES
9.1 The Gym reserves the right to make reasonable alterations to the type of facilities provided without notice and we shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services that occur. On occasions when necessary maintenance is required, the Gym, or parts thereof, may be closed. No refunds would be given as a result of closure.
9.2 The Gym reserves the right to change or remove any of the facilities at the Gym. In such an event notice will be given.
9.3 No persons under 16 years of age, or pets are allowed in to the gym facility at any time.
10. HOURS OF OPENING
10.1 Information in relation to the Centre's normal hours of operation are available on the website. Such hours may be lengthened or shortened at the absolute discretion of the Gym with or without any prior notice being given to members. The Gym shall endeavour to give members reasonable notice of change to such hours.
11. FIRE EVACUATIONS
If you discover a fire, operate the nearest fire alarm. If you hear the fire alarm:
Leave the building by the nearest exit.
Do not stop or return to collect personal belongings.
Go to the nearest/safest assembly point and remain there.
Return to the building only when authorised to do so by a Gym representative or emergency services.
12. THIRD PARTY RIGHTS
A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.
13. USE OF PERSONAL INFORMATION
We use the personal and transactional information (e.g. name, address, email address, phone number) ("Personal Information") you supply to us in order to fulfil your order. The lawful basis for this data processing while your membership is active is Contract. The lawful basis for the processing if your membership is cancelled or lapses is Legitimate Business Interest.
14. UNAUTHORISED ACCESS TO PERSONAL INFORMATION
Unless a member of our staff has been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorised access by a third party to the information (including in particular credit/debit card details) you transmit when you place an order. It is your responsibility to ensure the security of your own credit/debit card details to avoid unauthorised use.
CODE OF CONDUCT
By joining CrossFit Strength Base you agree to adhere to, abide by, and be subject to the following Code of Conduct.
CrossFit Strength Base operates a '3 Strike' rule, whereby cumulative breaches of the Code of Conduct may result in termination of membership.
This does not affect our right to remove membership as per the Terms and Conditions of joining.
We have introduced this system to positively impact on the experience of the majority of members.
The following behaviour / conduct can result in a 'strike' against the member where it has occurred without good reason:
Abusive behaviour to others
Aggressive behaviour to others
Failure to comply with a reasonable request from one of the Gym team
Failing to return weights/equipment after use to their correct location
Failing to wipe down equipment that you have soiled in some way
Propping fire, security, or emergency doors open
Tailgating when entering the Gym through any entrance, thus using another's entry details
Damage to equipment through careless and inconsiderate acts
If a member hits 3 Strikes, their membership will be terminated by the Gym.
Strikes remain on a members record for a period of 12 months.
And please remember to NEVER share your passcode or key fob with others, or communicate it elsewhere, as this will lead to membership termination.
