Hive Active’s terms and conditions of entry, together with our privacy policy, govern our relationship with our members, clients and visitors.
Our terms and conditions have been established to ensure our members, clients and visitors are aware of their rights and responsibilities whilst visiting and using our facility.
1. MEMBERSHIP, CLIENT AND VISITOR TERMS
All members, clients and visitors will choose one of the membership contracts or services offered by Hive Active. Different rates apply for each option. The member, client or visitor agrees to pay to Hive Active the fees applicable to the membership or service selected. The minimum charge will be the period of the contract chosen and this will be indicated on the direct debit payment form completed by the member, client or visitor in respect to the membership or service chosen. Payment cycles are fortnightly for memberships. Your membership contract will automatically renew to the same type of contract at the end of the period unless notified otherwise.
2. MEMBERSHIP AND VISITOR ACCESS
A Membership or Visitor/Multi-session pass commences on the date stated on the Stripe direct debit agreement form. A Membership and a Visitor Pass allows access to Hive Active’s sessions during operating hours. A Membership or Visitor/Multi-session pass is personal to the member or visitor and cannot be assigned or transferred to another person unless authorised by Hive Active.
3. DIRECT DEBIT PAYMENT
Hive Active uses an external company to manage the direct debit payment system. Payments to Hive Active via direct debit must comply with the Stripe terms and conditions. Please check all direct debit documentation before signing. The transaction fees from Stripe vary between 1.75% plus $0.30 for credit cards and 1% plus $0.30 for direct debit and are included in Hive Active's fees. There is also a $3 dishonour fee should your nominated payment option not work.
4. MEMBERSHIP AND VISITOR PASS CANCELLATION
Hive Active reserves the right to cancel a membership or visitor pass agreement at its discretion. The member may cancel their membership by giving Hive Active management a minimum of 14 days notice in writing prior to the affected member’s payment date after conclusion of their term period. Any cancelled members will be charged at current membership rates if they decide to rejoin.
5. MEMBERSHIP SUSPENSION/HOLD
A member may suspend their membership a maximum of twice per calendar year. A minimum of 7 days’ written notice prior to the affected payment must be given and all suspensions must be a minimum of 14 days. A date of recommencement of membership must be given for a member’s membership to be placed on hold. The member’s usual payments will be re-activated after their suspension period has been completed. Once a hold exceeds 28 days the membership will be cancelled and the cancellation terms will apply. Multi-session passes cannot be placed on suspension/hold and validity periods cannot be extended.
6. MEMBERS’, CLIENTS' AND VISITORS' RESPONSIBILITIES
A member, client or visitor will ensure they complete a Hive Active waiver form specific to the class or service to be undertaken online or to hand to the coach/staff member on duty before commencing their first training, massage or recovery session. A member, client or visitor agrees to provide an accurate health and fitness profile prior to and during engagement with Hive Active's training, massage and recovery programs and services.
The member, client or visitor is aware that photography may occur during training sessions and gives permission for this to be used for marketing purposes that may include but not be limited to, flyers, newsletters and the company website.
7. CONDITION OF ENTRY
The member, client or visitor agrees to abide by Hive Active’s Conditions of Entry and only use training and recovery equipment as instructed by a Hive Active coach or staff member. The member, client or visitor understands that these Conditions of Entry can change, and agrees to keep up to date on these changes.
You agree to abide by Hive Active facility rules as provided separately, attached or displayed in the facility. Hive Active reserves the right to vary, add or eliminate these rules as required. If a member, client or visitor continuously breaks any of the facility rules, Hive Active staff or management reserve the right to require you to leave immediately. This may also result in cancellation of membership, visitor pass or single session treatment.
In the case of Kids and Teens members, clients and visitors, the parent or guardian agrees that the member will follow Hive Active’s Conditions of Entry including the Behavioral Guidelines for junior members.
8. OPERATION OF FACILITY
Hive Active reserves the right to vary, add or eliminate from time to time the Open Hours or Scheduled Hours of any of our facilities, classes or services. Please check all timetables and member, client or visitor information for changes.
You agree and accept that a particular facility or service may not be available for participation due to a prior booking, mechanical breakdown, fire, loss of lease, or any other reason. You agree not to hold the centre responsible for such occurrences.
To be a member and participate in adult classes at Hive Active, you must be at least 16 years of age. Unless authorised by the facility management, children aged between 6yrs and 15yrs can only participate as part of a CrossFit Kids/Teens membership if available or with an organised group by prior arrangement with facility management.
9. USE OF WodBoard
As a member, client or visitor of Hive Active you have access to our WodBoard athlete and recovery platform. This can be used to manage your class and/or service bookings and keep us informed of any changes to your details.
All members and visitors must book into classes prior to attending and check in when you arrive at Hive Active for that class using our check in counter or through your mobile device. You are not permitted to attend a class without booking in for that class. Hive Active requires bookings to ensure the session and your progress can be planned effectively.
10. CANCELLATION OF APPOINTMENT BOOKINGS
We understand that sometimes life gets busy and you may need to reschedule appointments including Personal Training and Recovery sessions. Hive Active reserves the right to charge a 50% cancellation fee for any cancellations made within 4-24 hours of a scheduled appointment, and 100% cancellation fee for any missed appointment or cancellations made within 4 hours of the scheduled appointment
11. Disclaimer clause
The 'Company' refers to the Australian Registered Business Hive Active Pty Ltd.
The 'Activity' refers to participation in personal/group strength, fitness and conditioning training, recovery equipment use, massage and advices.
- I acknowledge that it is a condition of participating in this activity that I do so at my own risk.
- I accept all risks and hereby indemnify and release the Company, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly and indirectly associated with the Company, against all liability howsoever arising from injury or damage howsoever caused (whether fatal or otherwise) arising out of membership of this Company or participating in the activity or in any way whatsoever due to any negligent act, breach of duty, default and/or omission on the part of this Company, its directors, instructors, members, servants or agents to the extent permitted by law.
- This release and indemnity continues forever and binds my heirs, successors, executors, personal representatives and assigns.
- I acknowledge that participating in this activity may involve a risk of injury or even death from various causes including: over exertion, dehydration, equipment failure and accidents with equipment and surroundings.
- I recognise the difficulties associated with the activity and attest I am physically fit to participate safely in the activity and that a qualified medical practitioner has not advised me otherwise.
- I understand the demanding physical nature of this activity. I am not aware of any medical condition, injury or impairment that will be detrimental to my health if I participate in this activity. In the event that I become aware of any medical condition, injury or impairment that may be detrimental to my health if I participate in this activity, I will immediately inform the Company. By continuing to participate in this activity, I accept all risks despite these conditions and am still, and always will be, under the terms of this agreement.
- I am also aware that any person participating in the activity carried out by the Company are only allowed to do so on the distinct understanding that they do so at their own risk.
