MEMBERSHIP CONTRACT TERMS AND CONDITIONS
Membership fees shall be fixed by Hive and may be altered with one months notice to you at any time. Members will be notified (by notices posted on our web site and facebook page and email) of any changes in the fees prior to the date of the alteration.
1) On payment of membership fees, a member is entitled to use Hive facilities with frequency of use relating to the membership type.
2) The first membership subscription shall be due and payable on the signing of this agreement. Subsequent membership subscription shall be due and payable on the 1st of each month, or if the 1st day of the month is a Saturday, Sunday or public holiday, the next working day.
3) Hive reserves the right to reject an application for membership, or refuse admission, without ascribing any reason.
4) Membership fees are payable according to the membership type selected and a £15-30 joining fee exists for new memberships
DIRECT DEBIT
Monthly direct debits are a full binding contract between Hive and the member and will automatically continue until Hive is notified otherwise. Any membership must hold an active direct debit in order to be active. A membership without an active direct debit will be unuseable until instated. Hive uses the software platform Wodify to run its membership direct debit payments so card details will be needed to set up a membership agreement.
TERMINATION OF MEMBERSHIP
1) No membership cancellation is valid by any other medium other than a written email cancellation to team@hivefitness.co.uk. We will not honour verbal requests, Facebook messages, phone calls, etc.
2) Membership agreements must be cancelled by giving ONE FULL CALENDAR MONTH or more written notice prior to the 1st day of the calendar month in which to cancel the membership using the method above.
3) I understand that if I submit a membership cancellation email less than ONE CALENDAR MONTH prior to the 1st day of the calendar month in which the membership is to cancel that request is outside of the agreed notice period and will be charged in full for that month.
4) Hive is not liable to refund any monies in relation to monthly membership contracts should the receipt of cancellation not be received one calendar month before the last day of the proceeding month.
5) Hive reserves the right to refuse admission and/or to expel or suspend any member forthwith if any member shall, in the opinion of Hive, cause nuisance or annoyance to the other Hive members or guests; and for any breach of Hive's Code of Conduct, or for any other reason which Hive may deem appropriate.
9) If purchasing a membership within three calendar months of the last day of any previous membership a rejoining fee of £15-30 will be incurred.
PERSONAL TRAINING
1) Personal Training appointments require 24-hours notice of cancellation. Cancelling within this 24-hour period will result in the appointment being forfeit and any fees non-refundable.
2) All fees for Personal Trainer appointment must be made in advance of the date of the appointment.
3) All appointments, unless agreed, are 60 minutes in duration. Any late arrival to an appointment will still mean that the appointment will finish on pre agreed time.
CODE OF CONDUCT
The following Code of Conduct is applicable to all and has no exceptions. Purchase of any membership or service from Hive is deemed as acceptance to being bound by this full Code of Conduct:
All members, clients and guests must follow direction from all staff, directors and coaches of Hive at all times with no exceptions.
All members, clients and guests must conduct themselves in a friendly and polite manner. Intimidation, discrimination, harassment, blackmailing and general bullying towards any individual will not tolerated.
Any forms of aggression or pursuit including, verbal, sexual or physical assault to any individual is considered extreme misconduct and immediate expulsion may be imposed.
No member, client or guest shall make fellow members, clients, guests or staff feel uncomfortable or intimidated at any time.
It is required to wipe up sweat and clear equipment after you have finished your workout to ensure a safe environment for others.
For personal safety and safety to others do not leave any equipment on floor when not being used in your workout.
No intoxicated members, clients and guests are permitted to train. This includes alcohol, drugs or anything else that inhibits a persons judgement.
All members, clients and guests must respect the rights of all participants regardless of their gender, sexual orientation, ability, cultural background or religion.
Staff, directors and coaches reserve the right to refuse entry to any member, client or guest in breach of the above conditions. Members, clients or guests in breach of these conditions may have their membership or service terminated and be barred from the facility without prior notice.

SMOKING
Please note that Hive is a designated non-smoking environment.
MEMBERSHIP SOCIAL EVENTS
Hive reserves the right at any time, and without notice, to set aside facilities for membership social events.
GENERAL
1) Members are particularly advised not to undertake strenuous physical activities for which they might be medically unfit. Members who have any reservations as to their physical condition are advised to have a medical check-up before embarking on any exercise. The exercise programmes and facilities provided are designed with safety in mind, these are however used entirely at the members’ own risk.
2) Appropriate clothing must be worn. Access to the gym and booking classes can be carried out using your personal login to our online scheduling software.
3) Members perspiring excessively are advised to take the appropriate steps to prevent it affecting other members and wipe equipment after use.
4) Members must at all times observe the membership rules, and comply with any reasonable directions which the manager may give to ensure the smooth operation of Hive, the facilities and the convenience of members.
5) Credit shall not be granted by Hive to any member. Any and all costs incurred by the members during their visit to Hive must be paid prior to leaving.
6) Any dispute or difference that may arise with regard to the interpretation of these rules shall be determined by the manager whose decision shall be final.
7) Hive reserves the right to amend these rules and all tariff charges at any time and without notice to the individual members although notification of the change will be posted on the web site and facebook and via email. If any provision in these rules is declared illegal or otherwise unenforceable, the remaining provisions shall remain in full force and effect.
Classes
All WODs, classes, workshops and similar events provided by Hive must be booked in advance. No priority is given and places are allocated on a first-come-first-served basis.
Hive may take photographs & videos of classes & Open Gym sessions. Any member not wishing to have their image captured should state in writing that this is the case to team@hivefitness.co.uk. Content of members & people visiting the gym may be used for advertising purposes, booking in and accepting these conditions is giving consent for the use of your image
There is a £3 fee for no 'sign ins' to class. This is a no show
There is a 1.50 fee for late class cancellations. This is less than 3 hours prior to the reservation class time.
SAFETY
In the event of a fire, members are asked to make their way in an orderly fashion to the nearest available exit.
LOST PROPERTY
All lost property found on the premises should be handed into a Hive employee. Items will be stored for one month and then donated to local charities. We will not be liable for property losses.
LIABILITY
1) Hive cannot accept any liability for any accident to any member or guest that may occur on the premises other than the liability that may arise from negligence of Hive, its staff or agents.
2) Any member who suffers an accident on Hive's premises must report the accident, and the circumstances under which it occurred, to a staff member immediately following the accident.
5) Neither Hive its health & fitness specialist instructors or other employees, servants or agents (including every independent contractor from time to time employed by Hive) shall in any circumstances whatsoever be under any liability whatsoever to the applicant for any loss, damage or injury (including death) whether accidental or otherwise of whatsoever kind arising during or resulting from participating in the exercise programme.
GOVERNING LAW AND JURISDICTION OF THE COURTS
This agreement shall be governed by and construed with English Law and the parties agree to submit any disputes to the exclusive jurisdiction of the English Courts.
